Q: Can a spouse recover damages for personal injury as a result of an auto accident that was caused by the other spouse?

A: In some states, yes. The majority of states will allow one spouse to pursue the other for personal injuries and/or property damage resulting from an auto accident. Some insurance companies, however, have inserted clauses into the policy that prohibits this action. Other states have invalidated these clauses, which means that recovery can proceed.
