Q: If I was the passenger in a car, can I recover damages for injuries that were caused by the operator?

A: The answer to this question will vary depending on the state in which you reside. Some states consider the passenger as a ‘guest’ and will not allow the pursuit of legal action for injuries or death unless the accident was a result of the driver’s gross negligence of willful misconduct. Most states, however, will allow for recovery if the operator of the vehicle is guilty of ordinary negligence that results in injuries or damages.
