Q: I was a passenger in an automobile that was involved in a car accident, but I was not wearing my seatbelt. Can I still pursue damages against the driver for my injuries?

A: Yes. However, the damages that you are entitled to recover may be limited to the injuries that would have still resulted had you been wearing your seatbelt. In other words, you cannot recover damages for injuries that were sustained as a result of failing to buckle up.
