What is a legal separation?

Legal separation is a judicial declaration that the parties are separated. Even though the court finds that the circumstances make it intolerable for the parties to reside together, the marrige remains intact during the period of legal separation. Most states allow legal separation for upto one or two years. In the old fault era when parties had difficult time obtaining divorce, legal separations were popular. However, the no-fault divorce has reduced the number of couples seeking legal separations.
